LKK Speaking Engagement

LKK partner Sabina Sacco spoke at the 2017 Open de Arbitraje, which was held on 11 May in Madrid. Now in its third edition, the Open de Arbitraje has already established itself as one of the major yearly events on arbitration in Spain, bringing together in-house and external counsel, arbitrators and other stakeholders in domestic and international arbitration. This year’s Open was organized as a golf tournament, and covered topics in international investment and commercial arbitration, as well as issues specific to disputes in the construction industry and to the relationship between technology and arbitration and businesses and arbitration.

 

Ms Sacco was a member of the panel discussing investment arbitration, together with Tomas Leonard of Winston & Strawn, Barton Legum of Dentons, and John Adam of Latham & Watkins, and, acting as moderator, Francisco Málaga of Linklaters. The panel addressed two distinct topics relevant in investment arbitration: temporal issues of jurisdiction and cross-examination.  For the first topic, the panel presented a fact pattern to the audience, discussed temporal issues of jurisdiction that could arise, and identified five questions for the audience to vote on.  For the second topic, the panel discussed the sui generis nature of cross-examination in international arbitration and provided tips to a predominantly civil law audience.
