LKK partner nominated by Chinese Supreme Court to sit on International Experts Committee
Gabrielle Kaufmann-Kohler has been nominated as a member of the International Commercial Experts Committee created by Supreme People’s Court of China (SPC) to assist its two newly established China International Commercial Courts, or CICC.
The First and Second China International Commercial Courts, seated in Shenzhen and Xi’an respectively, have been established in June 2018 as permanent branches of the SPC, to deal with, in particular, cross-border disputes arising out of projects under the Belt and Road Initiative. According to their governing rules, which came into effect on 1st July 2018, the CICC are composed of senior domestic judges, familiar with international law and trade, and able to work in both Chinese and English.
The International Commercial Experts Committee, comprising mainly non-Chinese nationals with the requisite international reputation and expertise, will advise on the future development of the CICC. In addition, the Committee’s members may be called upon, inter alia, to provide guidance in relation to applicable foreign laws, international treaties or customary rules, and, where so requested by the parties, to act as mediators in specific disputes.
