LKK Lawyers Secure Win before the Swiss Supreme Court

LKK ’s Sébastien Besson and Patrick Pithon have secured a victory for the Bolivarian Republic of Venezuela in annulment proceedings before the Swiss Supreme Court.

In decision 4A_466/2023, published on 11 March 2025, Switzerland’s highest court dismissed the challenge brought against a Permanent Court of Arbitration award that declined jurisdiction over a dual national’s claims against the State (PCA case n. 2020-56). In so doing, the Supreme Court fully upheld the State’s arguments and ordered the applicant to bear the entire costs of the proceedings and pay a substantial indemnity for the State’s legal costs. In the course of the proceedings, the Supreme Court also granted Venezuela’s application seeking security for costs.

To date, LKK lawyers have represented parties in more than 90 annulment proceedings before the Swiss Supreme Court, relating to international commercial, investment and sports arbitration awards.
