LKK Speaking Engagement

LKK senior associates Rahul Donde and Michele Potestà participated, as speaker and moderator, in a Panel discussing “Third Party Funding in International Arbitration” at a conference jointly organized by the ICDR Young & International and the Geneva Center for International Dispute Settlement on “Emergency Relief and Third Party Funding in International Arbitration: Emerging Issues” in Geneva on 26 January 2017.

 

In his presentation “What effect does the presence of a third party funder have on arbitral proceedings?”, Mr. Donde explored how an arbitration is affected once a third party funder is involved. He reviewed applications for security for costs, disclosure, waiver of privilege and issues concerning costs. The Panel discussion, moderated by Dr. Potestà, also addressed the question whether States and arbitral institutions should regulate third party funding, and the funder’s role from the funder’s perspective.
